Subparagraph (4) of Article 9 of the Competency Certificate Communiqué dated 17 December 2009 and numbered 27436 states: “The project owner regarding the projects for which an EIA Positive Decision has been given shall submit to any of the institutions/organizations authorized within the scope of this Communiqué whether the commitments specified in the initial and construction periods of the investment have been fulfilled.” is obliged to visit the project site and carry out on-site monitoring and control until the investment is put into operation.” provision is included.

In accordance with the EIA Regulation, it is a legal obligation to carry out environmental monitoring during the beginning and construction periods of projects for which an “EIA Positive/EIA Not Required” decision has been given. The purpose of environmental monitoring is to check whether planned and/or committed works are being carried out. Monitoring-control periods are determined at the review and evaluation commission meeting, and the number of monitoring-control reports that need to be prepared varies accordingly. Environmental monitoring-control studies are reported in the periods determined by the Ministry during the EIA process and presented to the Ministry of Environment and Urbanization and the Provincial Directorate of Environment and Urbanization.
